Questions families ask
General answers, before you meet
General information only, not legal advice. For your own situation, the free 30 minute meeting is the place to ask.
Do I need a will or a trust in Maryland?
It depends on your family and what you own. A will says who gets what and names a guardian for your children, and it goes through probate. A revocable living trust can hold your assets during your life and pass them without probate, and can manage money for children over time. Many plans use both. The firm explains the options at the first meeting. For your own situation, the free 30 minute meeting is the place to ask.
What happens if I die without a will in Maryland?
Maryland law then decides who inherits, in a fixed order that starts with a spouse and children, and a court appoints someone to handle the estate. The law cannot know your wishes, so the result may not match them, and it does not name a guardian you chose for your children. For your own situation, the free 30 minute meeting is the place to ask.
What is a revocable living trust?
It is a trust you set up during your life and can change or cancel while you are alive. You usually manage it yourself while you can, and name a successor trustee to take over if you become unable to or after your death. Assets have to be moved into the trust for it to work. For your own situation, the free 30 minute meeting is the place to ask.
Can I write my own will?
You can, but a will that is not signed and witnessed correctly, or that leaves out a guardian, a backup, or assets held outside the will, may not do what you meant. The firm's process is built to catch those gaps and to make sure documents are properly executed. For your own situation, the free 30 minute meeting is the place to ask.
I already have a will. Do I need a new one?
Maybe. The booking form asks whether you have a will that needs updating, because many do. Moves to a new state, new children, a marriage or divorce, or new property are common reasons to update. For your own situation, the free 30 minute meeting is the place to ask.
What is an executor?
The executor, called a personal representative in Maryland, is the person who settles your estate: gathers assets, pays debts and taxes, and distributes what is left as your will says. Pick someone organized and trustworthy, and name a backup. For your own situation, the free 30 minute meeting is the place to ask.
Does divorce or marriage change my will?
It can. In Maryland, a divorce generally cancels gifts in your will to the former spouse, but beneficiary forms and other documents may not change on their own. Marriage and remarriage raise their own questions, especially in blended families. Review your whole plan after either. For your own situation, the free 30 minute meeting is the place to ask.
What if I own property in another state?
Real estate in another state can mean a second probate there. A trust is one common way to avoid that. Ruby is licensed in Maryland, Virginia, DC and New Jersey, so mention every state where you own property. For your own situation, the free 30 minute meeting is the place to ask.
How are documents signed?
Signing is part of the implementation step, and the firm makes sure each document is executed properly. In Maryland a will must be in writing, signed by you, and witnessed by two people. Powers of attorney and some other documents have their own formalities, which the firm handles at signing. For your own situation, the free 30 minute meeting is the place to ask.
What happens after my plan is signed?
Some plans need follow up after signing, such as retitling accounts or property into a trust and checking beneficiary designations, so the plan works the way it was designed. The firm's ongoing support step covers reviews and updates. For your own situation, the free 30 minute meeting is the place to ask.
